1. Provider and scope
The organiser and contracting party for everything offered under the name Midnight Havana is:
Kaizen Travel e.K.Paul-Francke-Straße 2
13156 Berlin, Germany
Register court: Amtsgericht Charlottenburg
Commercial register: HRA 60110
Email: info@midnight-havana.de
These terms cover our salsa and rueda group classes, social dance nights, parties and combinations of a class and the evening that follows. Bookings can be made through Eversports, through Urban Sports Club or at the door. For bookings made through a third party, that platform's own terms apply in addition.
2. Booking and reservation
Listing a class or an event is an invitation to book. For an online booking the contract comes into being when we or the booking system confirm it; at the door, when the booking is accepted and paid for. A place is reserved once payment has gone through or a booking has been confirmed. Where numbers are limited, there is no entitlement to take part without a confirmed booking.
3. Prices and payment
The prices shown at the time of booking apply. You can pay through Eversports, through Urban Sports Club, by card at the venue or in cash. Unless stated otherwise, the full price is due before the class or event begins.
4. Reduced price
For offers marked accordingly we give students and people on a low income a reduction on the stated price. We may ask for current proof; without it the difference to the standard price is payable. Discounts, vouchers and special offers cannot be combined unless we say so explicitly.
5. Loyalty card
Dance ten times and the eleventh is free. After ten qualifying visits, a completed card entitles you to one further free qualifying visit. It cannot be exchanged for cash, is personal to you and is not transferable. We may change or end the scheme for the future; anything already earned in full is unaffected.
6. Cancellation and not turning up
A booked class can be cancelled up to six hours before it starts. If you cancel in time, what you paid is credited towards a comparable future visit rather than refunded.
Cancelling less than six hours before the class, or not turning up, gives no right to a refund or a credit. Costs we save and any reallocation of the place are taken into account, and you may show that we suffered no loss or a much smaller one. Bookings through Eversports or Urban Sports Club may be subject to those platforms' own rules.
7. Who can take part, and at which level
Participation is open to people aged 18 and over. Classes marked Advanced assume practical knowledge of, in particular: pa' dentro y pa' fuera, exhíbela, Lazo, dame, dame dos, directo, enchufla, una arriba, Interior and La vecina.
Teachers may place someone in a different level according to their actual ability where this is needed for the class to work or for safety. Your own assessment alone does not create a right to a particular level.
8. Health
Dancing is physical activity. You are responsible for judging whether you are physically and medically able to take part, and should stop any movement that is clearly beyond your ability. Safety instructions from the team must be followed. Our statutory duties of care are unaffected.
9. Changes to the programme
We may make reasonable changes to the announced programme as long as the basic character of what you booked stays the same. This covers teachers, DJs, individual class content, rooms, times and the order of the evening. Where a change is substantial we will offer a reasonable alternative; if that is not acceptable or not possible, we refund what you paid for the affected part.
10. Cancelled classes and events
We may cancel a class or an event, in particular because a teacher is ill, the venue is unavailable, there are serious technical or organisational problems, or in cases of force majeure. We will offer a replacement date where we can. If that is not taken up, or no suitable replacement can be offered, we refund what you paid.
11. Conduct and exclusion
Midnight Havana is meant to be a respectful and safe space for everyone. All guests are expected to treat each other with respect and to honour personal boundaries.
We do not tolerate:
- harassment or unwanted physical advances
- aggressive or threatening behaviour
- discriminatory, insulting or demeaning behaviour
- heavy intoxication or a comparable state that affects or endangers other guests
- endangering other guests, teachers or staff
- ignoring safety instructions from the Midnight Havana team
Serious or repeated breaches can lead to exclusion from a class or an event and to being asked to leave, in serious cases without a warning first. Where the exclusion follows a serious breach you are responsible for, there is no right to a refund.
12. Photos and video
Photos and video may be taken at our events and used to document them and to present Midnight Havana, where there is a legal basis for doing so. Simply attending is not blanket consent to every form of publication of your image. If you would rather not be photographed or filmed, tell the event team or the photographer. See ourprivacy policy for more.
13. Cloakroom
Where a cloakroom is offered, it is free and included in the admission price, and it is supervised during normal event hours. Liability follows the statutory rules and clause 14. Please do not leave valuables in clothing or bags.
14. Liability
We are liable without limit:
- for intent and gross negligence
- for injury to life, body or health
- in other cases of mandatory statutory liability
For slight negligence in breaching an essential contractual duty, our liability is limited to the foreseeable damage typical of this kind of contract. Otherwise liability for slightly negligent damage to property or financial loss is excluded as far as the law allows. These rules apply equally in favour of our staff, teachers and agents.
15. Right of withdrawal for online bookings
For contracts about leisure services tied to a specific date, § 312g(2) no. 9 of the German Civil Code means there is no statutory right of withdrawal. That covers booking a class or an event online for a particular date. The cancellation option we offer voluntarily under clause 6 is unaffected.
16. Data protection
Personal data is processed in line with the applicable rules. See ourprivacy policy.
17. Consumer dispute resolution
Kaizen Travel e.K. is not obliged and is generally not willing to take part in dispute resolution proceedings before a consumer arbitration board.
18. Final provisions
German law applies. For consumers this choice of law applies only so far as it does not remove the protection of mandatory consumer rules of the country where they normally live. If a provision is or becomes invalid, the rest stays in force and the statutory rules take the place of the invalid one.
